Terms of Service.
These Terms of Service (the "Terms") govern your access to and use of the Odyssey iOS application (the "App"), the website at odyssey.app (the "Site"), and any related services we provide (together, the "Service"). The Service is operated by Odyssey Commerce LLC, a limited liability company formed under the laws of the State of Wyoming, United States, with its registered office at 1603 Capitol Ave Ste 415, Cheyenne, WY 82001 ("Odyssey", "we", "us", or "our").
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
This is an agreement between you and Odyssey, not Apple. Apple Inc. is not a party to these Terms and is not responsible for the App or its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.
01Eligibility
You must be at least 16 years old to use the Service. If you are between 16 and the age of majority in your jurisdiction, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not directed to children under 16, and we do not knowingly collect personal information from them.
02Licence to use the App
Subject to your compliance with these Terms, Odyssey grants you a limited, non-exclusive, non-transferable, revocable licence to download and use one copy of the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions. The licence is for your personal, non-commercial use only.
You agree that you will not, and will not permit any third party to:
- copy, modify, adapt, translate, or create derivative works of the App;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by applicable law;
- rent, lease, lend, sell, sublicense, distribute, or transfer the App to any third party;
- remove, alter, or obscure any proprietary notices on the App;
- use the Service to violate any law or to infringe the rights of any person.
03Accounts
Some features require you to create an account. You can register with an email address and password, or by using Sign in with Apple. If you use Sign in with Apple, your account is linked to the Apple ID credential you provide, and you may choose to share or hide your email address through Apple's private email relay. You agree to provide accurate information, keep your credentials confidential, and notify us immediately at support@odyssey-store.com of any unauthorised use of your account. You are responsible for all activity that occurs under your account.
04Subscriptions and payments
Free trial
New users may receive a free trial period of up to 21 days (the "Trial"). The exact length and availability of the Trial may vary and will be displayed at the point of sale.
Auto-renewing subscriptions
After any Trial ends, paid access to the App is sold as an auto-renewing subscription. The price and renewal period are displayed in the App before purchase and are typically $4.99 per month (or the local equivalent set by Apple). Your subscription will renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
How to cancel
- App Store purchases (iOS): manage and cancel your subscription in Settings → [your name] → Subscriptions on your Apple device. Cancellations take effect at the end of the current billing period.
- Web purchases (Stripe): manage your subscription via the billing portal linked from your account, or by emailing support@odyssey-store.com.
Refunds
Refunds for App Store purchases are handled solely by Apple under the Apple Media Services Terms. Refund requests must be submitted at reportaproblem.apple.com. For Stripe-processed web purchases, contact us within 14 days of the initial charge and we will consider your request in line with applicable consumer-protection law.
05Maintenance and support
Odyssey is solely responsible for providing any maintenance and support services with respect to the App, to the extent any such services are required under applicable law. Apple has no obligation to provide any maintenance or support. You may contact us at support@odyssey-store.com for support enquiries.
06Warranty disclaimer
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Odyssey disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Apple-specific: Odyssey is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
The Service is not medical advice. Odyssey is a wellness and behaviour-change tool, not a healthcare product. It does not diagnose, treat, cure, or prevent any condition. If you are struggling with addiction, compulsive behaviours, mental-health concerns, or thoughts of self-harm, please contact a qualified healthcare professional or your local emergency services.
07Limitation of liability
To the maximum extent permitted by law, Odyssey, its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service — even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the claim, or (b) USD 50.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.
08Product claims
Odyssey, and not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product-liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer-protection, privacy, or similar legislation.
09Intellectual property
All right, title, and interest in and to the App and Site — including all text, graphics, audio, logos, code, trademarks, and the "Odyssey" name — are owned by Odyssey or its licensors and are protected by intellectual property laws.
If a third party alleges that the App or your possession or use of the App infringes its intellectual property rights, Odyssey, and not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
10User content
The App allows you to record private journal entries and reflections ("User Content"). Journal entries are designed to remain on your device and are not transmitted to our servers. Where the App requires you to submit information to us (for example, to support requests), you grant us a worldwide, royalty-free, limited licence to use that information solely to provide and improve the Service.
You retain all rights in your User Content.
11Acceptable use
You agree not to:
- use the Service in any way that violates applicable law;
- interfere with, disrupt, or attempt to gain unauthorised access to the Service or any related systems;
- introduce malicious code or attempt to probe, scan, or test the vulnerability of any system or network;
- misrepresent your identity, impersonate another person, or use another person's account without permission.
12Termination
We may suspend or terminate your access to the Service at any time if you breach these Terms or if we are required to do so by law. You may stop using the Service at any time by deleting the App and cancelling any active subscription. Sections that by their nature should survive termination will survive, including Sections 6–9, 13, 14, and 16–18.
13Legal compliance
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
You also agree to comply with all applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
14Third-party services
The Service relies on third-party providers, including:
- Apple Inc. — App Store distribution, in-app subscriptions, and platform services;
- Supabase, Inc. — backend, authentication, and account-data storage;
- PostHog, Inc. — product analytics;
- Stripe, Inc. — payment processing for web-based purchases.
Your use of these services may be subject to their own terms. We are not responsible for the practices of third-party services. See our Privacy Policy for how we use these providers and what data is shared with them.
15Apple as a third-party beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
16Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. You and Odyssey agree to submit to the exclusive jurisdiction of the state and federal courts located in Laramie County, Wyoming, save that nothing in this section limits any non-waivable right you may have to bring proceedings in the courts of your country or state of residence under applicable consumer law.
17Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will provide reasonable advance notice (for example, by email or via the App). Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
